1. Who We Are
These terms govern your use of SearchPresence, provided by:

In these terms, "we", "us", and "SearchPresence" refer to Dominik Iwoła. "You" refers to the person or legal entity using our service.
2. Agreement
By using SearchPresence — visiting our website, joining the waitlist, requesting a free audit preview, or purchasing a paid audit — you agree to these terms and to our privacy policy and cookie policy.
If you are using SearchPresence on behalf of a company or other organisation, you confirm that you have authority to bind that organisation to these terms, and "you" in these terms means that organisation.
If you do not agree to these terms, do not use SearchPresence.
3. What SearchPresence Is
SearchPresence is an audit product. You submit a URL and we produce a report assessing how the page performs across four pillars: SEO, AEO (answer engine optimisation), GEO (generative engine optimisation), and AIO (AI-overview readiness). Optional add-ons extend the report with Paid Readiness analysis and Competitor Comparison.
The report is a diagnostic and recommendation document. It is not a guarantee of any ranking, traffic, conversion, or other outcome. SEO, AEO, GEO, and AIO outcomes depend on factors outside our control, including third-party search engines, AI systems, and your own implementation choices. See §13 (Disclaimers) and §14 (Liability).
4. Eligibility and Account
You must be at least 16 years old (or the higher age required by the law of your country) to use SearchPresence.
You may use the audit service without an account for free previews and single audits. When account-based features are introduced, you will be responsible for keeping your account credentials confidential and for all activity that occurs under your account.
5. The Audit Service
5.1 What is included
A Full Audit consists of:
- analysis of one URL you submit
- a report across the four core pillars (SEO, AEO, GEO, AIO)
- a prioritised fix plan
- PDF export and a shareable link
- one (1) included same-URL re-audit, claimable within 90 days of
audit completion
A Site Pack is a bundle of Full Audit credits (5, 10, or 25) valid for 12 months from purchase. Each consumed credit produces its own Full Audit with its own 90-day included re-audit window.
Add-ons (Paid Readiness, Competitor Comparison — single or trio) are purchased per audit at checkout.
The detailed time limits referenced above are recorded in and are binding for the operation of the service.
5.2 Free Preview
The Free Preview is a limited automated diagnostic. You can submit a URL and receive a high-level score and a small number of findings at no charge. We may rate-limit Free Previews per IP address and per URL to prevent abuse.
5.3 The included re-audit
Every paid Full Audit (whether purchased standalone or via a Site Pack credit) includes one same-URL re-audit, redeemable within 90 days of the original audit completion. The re-audit:
- must be for the same URL as the original audit
- does not repeat add-ons unless the original purchase included them
- is forfeited if not claimed within the 90-day window
After the 90-day window, a new Full Audit must be purchased for the same URL.
5.4 Site Pack credit validity
Site Pack credits are valid for 12 months from the date of pack purchase. Unused credits expire at the end of that 12-month window. The available credit count and expiration date will be shown in your account view (when available).
5.5 Freshness state
Every audit report carries a freshness state computed from the audit completion timestamp:
- Fresh — audit completed within the last 30 days
- Aging — audit between 30 and 90 days old, inclusive; the included
re-audit is still claimable
- Stale — audit older than 90 days; we recommend purchasing a
fresh Full Audit
The freshness state is informational. It does not reduce the validity of any data already delivered to you.
6. Prices, Currency, and Taxes
6.1 Currency
We display prices in USD, EUR, or PLN depending on your locale and country, as set out in our pricing policy. The currency shown at checkout is the currency you will be charged.
6.2 Taxes
Prices on the website are shown exclusive of VAT unless explicitly stated otherwise. The applicable VAT will be added at checkout based on your country and, for B2B purchases, on your VAT number.
- For purchases from the European Union, we apply VAT in accordance
with the EU VAT One Stop Shop ("VAT-OSS") rules where applicable.
- For B2B purchases from a different EU country with a valid VAT
number, the reverse-charge mechanism applies and we issue an invoice without VAT.
- For purchases from outside the EU, no EU VAT is charged; your local
tax obligations are your own responsibility.
6.3 Payment
Payments are processed by Stripe. We do not store full card numbers. By submitting a payment, you authorise the charge for the amount shown at checkout in the chosen currency.
6.4 Invoices
We issue an electronic invoice for every paid purchase, sent to the email address you provided at checkout. You can request a corrective invoice for clerical errors within 30 days of issue.
6.5 Promotional discounts
From time to time we may offer promotional discount codes. Each code has its own terms (eligibility, validity period, currency, single-use or multi-use). Promotions are not cumulative unless explicitly stated.
The waitlist launch promotion is available only to people who joined the waitlist before our public launch and is automatically discontinued at the moment of public launch ; coupons already issued remain valid until their stated expiry. See our pricing policy0 for context.
7. How Payment Forms the Contract
A contract for the audit service is formed when:
1. you complete checkout 2. we successfully charge your payment method 3. we send you an order confirmation by email
If any of those steps fails, no contract is formed and any captured amount will be released or refunded.
8. Delivery
We deliver each audit by:
- making the report available in your account or via a unique
shareable link, and
- emailing you a notification with the report link
The audit is typically delivered within minutes of purchase. We do not guarantee a specific delivery time. If we cannot deliver an audit within 24 hours of purchase, we will proactively refund the full purchase amount without requiring you to request it. 9. Right of Withdrawal (EU Consumers Only)
This section applies if you are a consumer resident in the European Union — that is, you are an individual purchasing for purposes outside your trade, business, craft, or profession.
SearchPresence operates a pre-generation model: when you submit a URL for a Free Preview, our system immediately generates the full audit report. Checkout purchases access to that already-generated report. Performance of the digital content therefore begins — and in practice completes — before or at the moment of purchase.
Under Article 16(m) of EU Directive 2011/83/EU on consumer rights, the 14-day right of withdrawal does not apply to contracts for the supply of digital content not on a tangible medium where:
1. performance has begun with your prior express consent, and 2. you have acknowledged that you thereby lose the right of withdrawal.
At checkout, we ask you to give that express consent and acknowledgement. By ticking the corresponding box and confirming the purchase, you:
- expressly consent to performance of the audit service (which has
already begun or completed by the time you reach checkout), and
- acknowledge that you thereby lose your right of withdrawal.
For B2B purchases (purchases by businesses for business purposes), the right of withdrawal does not apply.
10. Refunds
Refund posture is set in our pricing policy0. In summary:
- Service failure refund. If our audit pipeline fails to produce a
valid report for a successfully charged audit, you are entitled to a full refund of the affected audit. For Site Packs, this means a refund of the affected credit, not the entire pack.
- No refund on completed deliverables. We do not refund audits
that have been delivered. The included re-audit is part of the deliverable; an unused re-audit on a delivered audit does not entitle you to a refund.
- Site Pack expiration. Unused credits that expire after the
12-month validity window are not refundable. Support may grant a one-time extension at its discretion; this is not a contractual right.
- Statutory rights unaffected. Nothing in this section reduces
your rights as an EU consumer under mandatory law.
To request a refund, email hello@searchpresence.app with your order number and the reason for the request.
11. Acceptable Use
You agree not to:
- submit URLs you do not have a lawful right to audit, including URLs
whose terms of use prohibit automated access in a way that would make our audit unlawful for you to commission
- submit URLs that point to illegal, harmful, or infringing content
- use the service to scrape or systematically extract content from
third-party websites beyond what is necessary for an audit
- reverse-engineer, decompile, or attempt to extract the source code
or prompts of our audit service
- resell, sublicense, or otherwise redistribute the service or its
outputs as a substitute for a SearchPresence audit purchased by your client, unless you have an agency/white-label arrangement with us
- use the service in any way that violates applicable law
We may suspend or terminate your access if we reasonably believe you are using the service in breach of this section.
12. Ownership and Licence
12.1 The platform
We own the SearchPresence platform, including the website, audit engine, prompts, scoring logic, code, designs, and the look and feel of the reports. Nothing in these terms transfers any of those rights to you.
12.2 Your content
You retain ownership of any content you submit (for example, URLs, billing details, and feedback). You grant us a worldwide, non-exclusive, royalty-free licence to use that content as necessary to operate the service, including transmitting page content to our LLM sub-processors for analysis as described in the privacy policy §5.
12.3 Your reports
Upon successful payment, you receive a non-exclusive, non-transferable, non-sublicensable licence to use the audit report you purchased for your own internal purposes, including sharing it with stakeholders or clients of your business. You may not republish the report or its contents in a way that misrepresents it as produced by anyone other than SearchPresence.
12.4 Agencies
If you are an agency intending to use the service to deliver audits under your own brand, contact us about a white-label arrangement. Without such an arrangement, this clause does not grant you the right to remove or obscure SearchPresence branding from delivered reports.
13. Disclaimers
We provide the service "as is" and "as available" to the extent permitted by law.
We do not warrant:
- that any specific ranking, traffic, conversion, citation, or other
business outcome will result from acting on the audit
- that the audit will identify every issue with your page
- that the audit will remain accurate as third-party search engines,
AI systems, or your page change over time
- that the service will be uninterrupted, error-free, or available at
any specific time
The audit is generated partly by automated language-model analysis. While we apply confidence-aware scoring, evidence quoting, and deterministic baselines , the audit may still contain errors or interpretations you disagree with. Treat the report as a starting point for decisions, not as advice on which you may rely without your own judgement.
Nothing in this section limits any warranty that cannot be excluded under applicable law, including mandatory EU consumer protections.
14. Limitation of Liability
To the maximum extent permitted by applicable law:
- our total aggregate liability for any claim arising out of or in
connection with the service is limited to the total amount you paid to us for the affected purchase in the twelve (12) months preceding the event giving rise to the claim
- we are not liable for indirect, incidental, consequential, special,
or punitive damages, lost profits, lost revenue, lost data, or business interruption
Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law, including liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- breach of mandatory consumer rights
15. Indemnity
You agree to indemnify and hold us harmless from any third-party claim arising from your breach of §11 (Acceptable Use) or your submission of URLs you did not have a lawful right to audit. This does not apply to the extent applicable law prohibits a consumer indemnity.
16. Suspension and Termination
We may suspend or terminate your access to the service if you breach these terms, if your payment fails, or if we are required to do so by law.
You may stop using the service at any time. Termination does not entitle you to a refund except as set out in §10. Provisions that by their nature should survive termination (including §12.1, §13, §14, §17, and §18) survive.
17. Changes to These Terms
We may update these terms from time to time. We will publish the updated version at this URL with a new "Last updated" date. For material changes that affect your rights, we will give reasonable advance notice via the website or, where we have your email, by email.
If you do not agree to a material change, your remedy is to stop using the service. Continued use after the change takes effect is acceptance of the updated terms.
18. Governing Law and Jurisdiction
These terms are governed by the law of the Republic of Poland, without prejudice to any mandatory consumer protections in your country of residence.
Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts competent for the registered seat of Dominik Iwoła, without prejudice to:
- the right of an EU consumer to bring proceedings in the courts of
their place of residence, or
- the right of an EU consumer to be sued only in the courts of their
place of residence,
as provided by EU Regulation 1215/2012 (Brussels I recast).
EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
